For many of our services we offer a published fixed price, in all other instances your lawyer will be able to provide you with a price having discussed your case and understood the work involved to get you to a particular stage. 

Choosing a fixed price service from Yeo Law provides you with certainty about the help you will receive and the amount you will have to pay. 

Sometimes there will be additional fees to pay to the Courts or, for example, to obtain copy documents. These costs will always be explained by your lawyer.

Fixed price uncontested divorce for Petitioner

This fixed price is relevant if you are the ‘Petitioner’, i.e. the one initiating the divorce proceedings.

If you choose our fixed price uncontested divorce package, you will get:

  • your case managed by an experienced family lawyer
  • all your divorce paperwork taken care of
  • all matters relating to your case explained to you every step of the way

What is an uncontested divorce? 

An uncontested divorce is one where you and your spouse have agreed to obtain a divorce. It assumes that the other party does not formally object to the divorce and that the Court accepts your ground for divorce without question (which is normally the case).

Your lawyer will collect all the relevant details from you, correspond on your behalf with the other parties involved (your spouse and their solicitor, if appropriate) and prepare and file all the relevant papers with the Court to obtain a divorce.

Your lawyer will obtain the information we need from you and send you a divorce procedure explanation. They will prepare and file all the appropriate paperwork as follows:

  • Generate Writ for Divorce, Statement of Claim, Memorandum of Appearance, Acknowledgement of Service
  • Drafting the Statement of Particulars and Draft Consent Order/Draft Interim Judgment from scratch
  • Make an application for the Interim Judgment
  • Make an application for the Final Judgment (Divorce) i.e. Certificate for Divorce.


Throughout the process your lawyer will keep you informed of progress.

In addition to the completion and filing or all the paperwork we include an allowance of up to 2 hours discussion with you by phone, e-mail or in person to address any concerns or issues arising from the paperwork. In the vast majority of cases this is more than sufficient to deal with the divorce process.

Court fees

The divorce Court will require you to pay standard government fees. These are currently $550  payable when the petition is filed. This is included in our total cost for a fixed price divorce. 

Additional fees 

In most cases the above follows through without difficulty. In some cases there can be additional issues to be resolved and we do charge extra for this additional work, examples can be: sorting out a financial agreement, advice on contact to children, not being able to trace the other party, the other party denying receipt of the papers, needing to obtain a private detective and so on.

If you decide to apply for an order to have your spouse pay the costs you have incurred in obtaining the divorce additional work may be required and your lawyer will explain the costs to you. In some instances you may be required to attend court to address this aspect of your case.

If you need advice on reaching a financial settlement with your partner or arrangements for your children this is likely to involve additional work which your lawyer will explain.

Any extra work and costs will be discussed and agreed with you before any work is undertaken.

Fixed price uncontested Defendant divorce

This fixed price package for defendant divorce in Singapore is relevant if someone is divorcing you and / or you have received divorce papers.

What is an uncontested Defendant divorce?

An uncontested defendant divorce is one where you have received (or have been told to expect) divorce papers from your spouse and you do not make a formal legal objection to the divorce going through.

You will be allocated a fully-qualified and experienced family lawyer to handle your divorce.

Your lawyer will collect all relevant details from you, correspond on your behalf with the other parties involved (your spouse and their solicitor, if appropriate) and prepare all the relevant papers.

They will explain the procedure to you and help you understand the process. They will deal with the relevant paperwork as follows:

  • Explain the grounds for divorce and the ancillary terms which will be prepared by the other party.
  • E-file the Memorandum of Appearance and Acknowledgement of Service.

In addition to the completion and filing of the paperwork above, we include an allowance of a one hour discussion with you by phone, e-mail, or in exceptional circumstances, in person. In most cases, this is more than sufficient to deal with all relevant issues.

*In the event of a dispute regarding whether you should contribute towards the other party’s legal costs of the divorce, the fixed price will not include any work required in this respect. This will be either charged at the standard hourly rate or a separate fee agreed. Any extra costs will be discussed and agreed with you before any work is undertaken.

Annulment

Annulment of a marriage (uncontested) 

You may apply for an annulment under Singapore law if your marriage is considered by the Court to be void (i.e. never existed) or voidable (i.e. deemed to be invalid under the law).

Marriages deemed to be void include situations involving Muslim parties registering their marriage in the civil registry, parties already married registering a subsequent marriage, marriages between parties who are closely related, marriages not properly solemnised, etc.

Marriages deemed to be voidable include marriages that have not been consummated, marriages between parties who have not given valid consent, marriages in which the wife is already pregnant with the child of another man, etc. The circumstances involved in annulments are not always straightforward and you should seek the help and advice of your family lawyer.

What is an annulment?

An annulment is a legal procedure for declaring a marriage null and void. Unlike a divorce which legally ends a valid marriage, an annulment treats the marriage as never having taken place.

Uncontested

This fixed price assumes that the other party does not formally object to the annulment and that the Court accepts the grounds. If you expect the case to be disputed by your spouse you should speak to a Yeo Law family lawyer about your case before booking a fixed fee annulment.

Your lawyer will prepare and file all the appropriate paperwork as follows:

  • A form called a ‘Writ for Nullity’ is completed by your lawyer and sent to the Court office.
  • The other party should then fill in a type of receipt saying whether they accept that the nullity should be granted. This is copied, to you.
  • You will need to attend Court for the final hearing.

Throughout the process your lawyer will explain each step and keep you updated on developments.

Court fees

The Court requires you to pay standard filing fees where applicable. These are currently $425 payable when the petition is filed. This is included in the total fixed price for an annulment above.

Additional fees

In most cases, the above follows through without difficulty and the time we spend on your case is covered by the fixed fee. In some cases, there can be additional issues to be resolved and we do charge extra for this additional work. Possible examples include: not being able to trace the other party, the other party denying receipt of the papers, needing to obtain a private detective or needing to deal with complicated medical issues.

Any extra costs will be discussed and agreed with you before any work is undertaken.

Prenuptial agreement

A prenuptial agreement is a document, signed before marriage, setting out the couple’s rights in relation to any property, debts, income and other assets purchased together or acquired individually (e.g. through inheritance).

It helps provide clarity for couples mainly in respect of their finances and children in their relationship. Your lawyer will obtain the information needed from you and create an agreement for your signature.

The Courts are not obliged under the law to enforce the agreement but unless the provisions go against the provisions of the Women’s Charter or there have been significant changes in the circumstances of the parties, they are likely to regard the agreement as very persuasive.

The price includes drafting and amending the agreement as well as time for discussions and advice. It assumes that you have agreed the general nature of what you would like to happen if your relationship ends. If you are in dispute about any aspects of the agreement you will need advice beyond what is provided by the fixed fee.

Assets over S$5  million 

This fixed price above is valid in cases where the assets of the couple concerned are below $5 million. Where there are assets above this value, a more detailed investigation of the finances is required which may involve other advisers (for example, independent financial advisors) and the discussions and negotiations may take longer.

Mediation at Child Focused Resolution Centre

Pursuant to Section 50(3A) of the Women’s Charter, it is mandatory for all divorcing couples with at least one child below 21 years of age to attend counselling and mediation at the Child Focused Resolution Centre. Both parties and their lawyers are required to attend the counselling and mediation together.

The mediator and Family Counsellor will meet with both parties and their lawyers to understand all relevant issues. Parties are expected to set aside about two hours for the whole session. Parties and their lawyers are requested to come prepared to discuss their post-divorce plans relating to the care of the children.

During the first session, the mediator may direct parties and their lawyers to exchange proposals for settlement, prepare financial documents relating to the matrimonial house and assets, list of expenses for the parties and the children and so on. The first mediation session would be usually be fixed where parties and their lawyers will attend to mediate towards an amicable and satisfactory settlement terms. Once parties reached an agreement to the terms, the mediator will order the filing of the Consent Order.
